Welcome to the online store of 10-8 Design LLC. By visiting our site and purchasing from us, you agree to the following Terms of Service. Please read them carefully.
1. Use of Our Website
You may not use our site or services for any illegal or unauthorized purpose. You must not transmit malware, harmful code, or attempt to interfere with the security or functionality of this website.
2. Product Information and Availability
We strive to display accurate product descriptions, photos, and pricing. Minor variations in color, placement, or materials may occur due to screen differences, production processes, or supplier variations. We reserve the right to modify or discontinue products at any time.
3. Custom Orders and Personalization
• All engraved, embroidered, and personalized products are final sale and non-refundable once production begins.
• By submitting text, artwork, logos, or other content, you confirm that you have the legal right to use that content.
• Customers are responsible for verifying the accuracy of all personalization details (spelling, dates, names, ranks, etc.).
• We are not responsible for errors submitted by customers.
• We may refuse any custom order containing infringing, offensive, or inappropriate content.
4. Order Acceptance, Changes, and Cancellation
• All orders placed are offers to purchase and are subject to acceptance by 10-8 Design LLC.
• We may cancel or refuse an order if fraudulent activity, incorrect pricing, or misuse is suspected.
• Non-custom orders may be canceled within 12 hours of purchase if production or shipment has not started.
• Custom orders cannot be canceled once design work, setup, or production has begun.
5. Production and Lead Times
• Custom engraved items typically require 5–7 business days.
• Embroidered items typically require 7–10 business days.
• Non-custom items typically require 2–4 business days.
• Production timelines may vary due to order volume, seasonal demand, or supply limitations.
6. Pricing, Promotions, and Free Shipping
• Prices are subject to change without notice.
• Promotional discounts cannot be retroactively applied to previous orders.
• We offer free standard U.S. shipping on orders over $60.
• Orders under $60 will have shipping calculated at checkout.
7. Shipping, Delivery, and Risk of Loss
• Once an order is handed to the carrier (USPS or UPS), responsibility for delivery passes to the customer.
• We are not responsible for delays, lost packages, or stolen packages after a carrier marks the order as delivered.
• Customers are responsible for providing accurate shipping information. Orders shipped to an incorrect address provided by the customer cannot be refunded or replaced.
• Delivery timelines provided at checkout are estimates and are not guaranteed.
8. Billing and Account Information
Customers must provide accurate, current, and complete purchase and account information.
We reserve the right to cancel or refuse orders if inaccurate or suspicious information is provided.
9. Color, Material, and Handmade Variations
Due to screen differences, material variances, and production methods, final products may show slight variations in color, engraving depth, embroidery thread tone, or placement. Small variations are normal and not considered defects.
10. Intellectual Property
• All designs, photos, logos, and content created by 10-8 Design LLC belong to us and may not be copied, reproduced, or used without our written permission.
• By submitting artwork or content for customization, you grant 10-8 Design LLC permission to use that material solely for production of your order.
11. Prohibited Uses
You may not use the site:
• For unlawful purposes
• To violate any law or regulation
• To infringe on our intellectual property or the rights of others
• To submit false or misleading information
• To upload malicious code
• To spam, phish, scrape, or harvest data
• To harass, abuse, or harm others
• To disrupt or interfere with site security or functionality
12. Third-Party Services and Tools
Our store uses third-party providers such as Shopify, payment processors, analytics tools, and apps. These providers have their own terms and policies. 10-8 Design LLC is not responsible for third-party services or issues arising from them.
13. Limitation of Liability
To the fullest extent permitted by law, 10-8 Design LLC is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our website or products.
14. Governing Law
These Terms of Service are governed by the laws of the State of Washington.
